NJM ELECTRONIC DISCLOSURE AND CONSENT

NJM Insurance Group is permitting you to pay your insurance premium(s) over the Internet from a checking or other account of your choice. We provide this service free of charge and will promptly notify you of any material changes to the hardware and/or software of this program. FIS, a company that supplies financial reporting capabilities to institutions such as banks, Internet banks, and finance companies, provides this online bill pay service to us while we in turn provide all services to you, our policyholder.

You hereby agree that electronic communications we send you will satisfy the requirement of "writing" for record-keeping purposes. You have the right to withdraw consent and instead receive communication in paper or in a non-electronic format; however, this may result in electronic bill paying becoming unavailable to you. You can withdraw this consent, update your contact information, or request a paper copy of the transaction by calling us at 1-800-690-6001, extension 4010, Monday through Friday, 8:00 a.m. to 5:00 p.m., by sending us an e-mail (ecash@njm.com), or by writing to us at:

TERMS AND CONDITIONS

You also agree to have sufficient funds in the payment account and to provide correct and valid information about yourself, including e-mail address, bank and bank account information.

If your financial institution does not send us payment as directed for any reason - including insufficient funds, incorrect account information, bank or payment account closure or suspension or similar circumstances - you agree to any or all of the following:

  • We may repeat the process of withdrawal until the bank provides payment for our transfer request;

  • We may suspend your ability to pay online; and/or

  • We may use all legal remedies available to collect the payment.

Failure to notify us could result in you becoming responsible for unauthorized use of your account. If you notify us within 2 business days, your loss cannot exceed $50.00. Business days are Monday through Friday, 8:00 a.m. EST through 5:00 p.m. EST, exclusive of holidays. If you do not notify us within 2 business days, you could be held responsible for up to $500.00 of the unauthorized transaction.

If an unauthorized transaction appears on your periodic statement, you must notify us within 60 days of transmittal of the statement, or you may become responsible for the payment. Failure to notify us within the specified time frame could result in you becoming legally liable for the entire amount of the unauthorized transaction. However, if your delay in notifying us was due to extenuating circumstances, we may extend these time frames.

You are responsible for installing, maintaining, and operating hardware and/or software in using this bill payment service. We are not responsible for errors, failures or malfunctions of your computer or software.

If we do not withdraw a payment on time or in the correct amount according to this agreement, we will be legally liable for the resulting losses or damages.

Some exceptions to this provision include:

  • If you have insufficient funds or your bank fails to honor payment;

  • If the bill payment service was not operating properly and you were made aware of the condition;

  • If circumstances beyond our control (such as terrorism, an act of God, etc.) make completion of the transaction impossible; and/or

  • If you fail to provide accurate and updated information.

Please note, if you use the automatic payment rule and your policy begins with the letters B, C, D, E, R, Q or Y, your yearly policy renewal payment and any late notices, including a cancellation notice will not automatically be deducted from your account. Payments for these invoices must be made separately on-line or by sending in a payment with the remittance coupon.

ERROR RESOLUTION

You must notify us within 60 days after your bank has informed you of an error with your policy number, the description of the error and the dollar amount of the suspected error. We may request that you inform us in writing.

We will notify you of our investigation results within 10 business days and will promptly correct any error. If we cannot resolve the discrepancy within 10 business days, we may take up to 45 days to resolve the matter. During this period, your account will be credited the amount of the error, pending the outcome. We will provide you with a written explanation within three business days after the final completion of our investigation. If we have credited your account, we have the right to reverse the credit accordingly.

NJM POLICYHOLDER CONSENT FOR PAPERLESS BILLING

1. Scope of Consent. If you do not wish to receive paper bills and instead want to view your bills electronically, you must first consent to this electronic transaction. Your consent to receive notifications and view documents electronically will apply only to paperless billing.

2. Requesting paper copies. You can obtain a paper copy of your bill by logging into your eCash Self-Enrollment account and printing it. Alternatively, you may request a paper copy of your bill by e-mailing us at ecash@njm.com or by contacting NJM at 1-800-232-6600, ext. 4010 (Accounts Receivable Department).

3. Hardware and software requirements. In order to receive notifications and view your bills electronically, you will need access to a computer and an account with an email service provider compatible with your email software. Your e-mail notifications and electronic bills may be made available in HTML or Adobe format. Your bill can be viewed electronically via the Web. You may retain a copy of your electronic bill by downloading and saving it the way you would any other file from the Internet. For viewing, printing, storing or downloading your electronic bill, you should use the newest version of your web browser. To access a printer-friendly version of your bill, you will also need Adobe Acrobat Reader.

If, after you consent to receive notifications and view bills electronically, the hardware and software requirements for access to and retention of your electronic bill changes, such that the change creates a material risk that you will not be able to access or retain electronic bills, NJM will provide you with a statement advising you of the revised hardware and software requirements for access to and retention of your electronic bill.

4. Withdrawing consent. You may withdraw your consent to receive notifications and view bills electronically. To do so, please utilize one of the following options: (1) log into your eCash Self-Enrollment account and select to discontinue the electronic service; (2) e-mail us at ecash@njm.com; (3) call us at 1-800-232-6600, ext. 4010; or (4) send a written request to NJM, Attn: Accounts Receivable, 301 Sullivan Way, W. Trenton, NJ 08628. We will not impose any fee relative to the withdrawal of your consent.

5. How to update your records. It is your responsibility to provide NJM with an accurate and complete e-mail address, and to maintain and update any changes in your e-mail address. You can update your information by logging into your eCash Self-Enrollment account, by emailing us at ecash@njm.com or by calling us at 1-800-232-6600, ext. 4010.

6. Statement of understanding. By consenting to this transaction, you agree that you have read and understood the terms described above, and that you consent to receive notifications and bills electronically.

CONFIDENTIALITY/PRIVACY

We may disclose information about you in order to verify the existence or condition of your account at a bank, to complete the transaction you have requested, or to comply with state and/or federal government agencies or court order.
