Zurich American Insurance Company is offering this payment service ("Service") as a convenience option to you, our valued customer. Currently, the Service is limited to the ability to make payment on your Zurich account electronically over the Internet.
PLEASE READ THESE SERVICE TERMS & CONDITIONS ("TERMS & CONDITIONS") CAREFULLY BEFORE USING ZURICH’S PAYMENT SERVICE. THESE TERMS & CONDITIONS GOVERN YOUR USE OF THIS SERVICE. IF YOU DO NOT AGREE TO THESE TERMS & CONDITIONS, DO NOT USE THIS SERVICE. BY USING THE SERVICE, YOU, AND ANY ENTITY YOU ARE AUTHORIZED TO REPRESENT FOR SUCH USE, CONFIRM YOUR AGREEMENT TO BE BOUND BY THESE TERMS & CONDITIONS. In these Terms & Conditions, “Zurich”, "we," "us" or "our" refers to Zurich American Insurance Company and its affiliated companies in the United States (“Zurich”) and, where specified, its Subcontractors (as defined below), and "you," "your" or "yours" refers to the user of the payment Service.
In addition to these Terms and Conditions, you should review our Frequently Asked Questions (FAQ), our Privacy Policy, and our Zurich North America website Terms of Use. The FAQ page includes important information about what browsers are currently supported by the Service, how information sent or received using the Service is encrypted for security purposes, and other information about how the Service works and how to get help if you have a problem using the Service. Our Privacy Policy includes important information about the type of information we collect about you, how we collect that information, and what we can do with that information.
These Terms & Conditions may be revised and updated by us at any time. Your continued use of the Service after any changes to these Terms & Conditions evidences your acceptance of such changes. You are responsible for reviewing these Terms & Conditions periodically for updates and changes.
This Service and the processing of payments through the Service may be provided, operated, or serviced by our subcontractors or third party service providers, including but not limited to data hosting, data servicing, and data verification providers, e-mail vendors, technical service providers, payment processors, and financial institutions ("Subcontractors"). By using this Service, you authorize us to share information with and use the services of our Subcontractors for processing your payments. Except as provided herein, and in our Privacy Policy and Terms of Use, your information is not shared with third parties.
These Terms & Conditions shall govern only the processing of payments through this Service and does not in any way modify or amend the rights of the parties relating to the underlying payment obligations. You should refer to your policy or the applicable underlying agreement for coverage terms and conditions, including payment amounts and due dates. Payment of past due amounts through this Service does not automatically reinstate policy coverage. If you have a question about your past due premium, please refer to the FAQs for additional information. Any payment due from you which cannot be completed through the Service for any reason will need to be made by you through an alternate payment method.
Various payment options may be available through this Service, including direct payments using electronic check withdrawals from your bank account (“ACH”) and/or credit card charges to your credit card account. Payments can be authorized by you as a one-time payment or a recurring payment basis. You may have the option to select fixed or variable payment amounts and fixed or variable payment processing dates depending on the type of payment due to Zurich. When you set up a payment method or create an automated payment rule using the Service, you will be required to agree to and authorize the specific payment terms applicable to the payment method selected by you. In some instances the amount due to Zurich cannot be determined until you submit information and/or reports required by the terms of a separate agreement under which such payment obligations arise. In such an instance, the payment amount and the date on which the payment authorized by you is actually processed by Zurich may vary depending on the information you report and when you submit the required information or reports. By selecting a recurring payment option, you agree you will not receive prior notice from Zurich of the specific amount and/or payment execution date of these payments. You agree not to dispute Zurich’s processing of payment transactions to your designated account so long as the transactions correspond to the terms authorized by you when you set up the payment method or created an automated payment rule.
You may terminate your authorization for payments by notifying Zurich in writing at least 30 days prior to your next payment date. For more information on how terminate a payment authorization, please refer to the FAQs.
You must maintain a valid e-mail address where you can receive messages, validation instructions, and other notices from us and our Subcontractors to use the Service. You agree to receive electronic communications from us and our Subcontractors regarding the Service, including but not limited to communications regarding your account profile, status and usage; changes to the Service, and payments made by you through the Service.
LIMIT OF LIABIITY AND INDEMNITY: USE OF THIS SERVICE IS AT YOUR SOLE RISK AND WE AND OUR SUBCONTRACTORS WILL NOT BE LIABLE TO YOU FOR ANY DAMAGE THAT YOU MAY SUFFER IN CONNECTION WITH THE USE OF THE SERVICE, UNLESS THE DAMAGE RESULTS DIRECTLY FROM OUR FAILURE TO PERFORM OUR EXPRESS OBLIGATIONS UNDER THESE TERMS & CONDITIONS. WE AND OUR SUBCONTRACTORS WILL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUANCE OF THIS SERVICE, INCLUDING THE INABILITY OR FAILURE TO MAKE A PAYMENT USING THE SERVICE WHICH MAY RESULT FROM SUCH MODIFICATIONS, SUSPENSIONS OR DISCONTINUANCES OR FOR ANY OTHER REASON. UNDER NO CIRCUMSTANCES WILL WE OR OUR SUBCONTRACTORS BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL OR INDIRECT LOSSES OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, OR AS A RESULT OF ANY DELAY, ERROR OR OMISSION IN ANY AUTHORIZED PAYMENT TO BE MADE, OR FROM ANY ACT OR OMISSION OF ANY FINANCIAL INSTITUTION, ELECTRONIC FUNDS TRANSFER SYSTEM, PAYMENT PROCESSOR, OR SUBCONTRACTOR , EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING BUT NOT LIMITED TO ANY BANK SERVICE CHARGES OR CREDIT CARD FEES YOU MAY INCUR FOR OVERDRAFTS, ERRORS, LACK OF FUNDS AVAILABILITY, OVER THE LIMIT FEES OR OTHER ACTIVITY IN YOUR BANK ACCOUNT OR YOUR CREDIT CARD ACCOUNT, OR ANY DAMAGES TO PROPERTY OR ANY VIRUSES THAT MAY AFFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY ON ACCOUNT OF YOUR USE OF THE SERVICE.
WE AND OUR SUBCONTRACTORS WILL NOT BE LIABLE FOR UNAUTHORIZED ACCESS BY THIRD PARTIES TO YOUR TRANSMISSION FACILITIES OR EQUIPMENT OR FOR UNAUTHORIZED ACCESS TO OR ALTERATION, THEFT, LOSS OR DESTRUCTION OF YOUR NETWORK, SYSTEMS, APPLICATIONS, DATA FILES, PROGRAMS, PROCEDURES, OR INFORMATION THROUGH ACCIDENT, FRAUDULENT MEANS OR DEVICES, OR ANY OTHER METHOD.
THESE LIMITATIONS OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT OR TORT, AND SHALL SURVIVE FAILURE OF AN EXCLUSIVE REMEDY.
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD US AND OUR SUBSIDIARIES, AFFILIATES, SUCCESSORS AND ASSIGNS, AND OUR AND THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS AND EXPENSES, INCLUDING ATTORNEYS FEES, ARISING FROM OR RELATING TO YOUR ALLEGED VIOLATION OF THESE TERMS & CONDITIONS, OR YOUR IMPROPER USE OF THE SERVICE.
DISCLAIMER OF WARRANTIES: All information provided on this Service is subject to change without notice. While efforts have been made to make the Service helpful and accurate, we do not warrant the accuracy of the information. We and our Subcontractors are not responsible for the accuracy of any information, including payment or Designated Account information that you provide to us through this Service. THIS PAYMENT SERVICE IS PROVIDED AS-IS, AND EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTY THAT THE SERVICE IS OF REASONABLY ACCEPTABLE QUALITY, AND ANY OTHER WARRANTIES ABOUT THIS SERVICE. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
ENFORCEMENT AND CHOICE OF LAW: These terms and Conditions shall be governed by the laws of the state of Illinois, without regard to its conflict of laws principles. For all disputes arising from or related to this Service, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Illinois. If any part of these Terms & Conditions is unenforceable, such part will not make any other part hereof unenforceable.
AUTHENTICATION AND AUTHORIZATION FOR SERVICE USAGE
This Service incorporates commercially reasonable methods to authenticate the information that you have supplied for making a payment through this Service. You will not be able to submit a payment until the Service authenticates you and you will not be allowed to use the Service to make payments to your Zurich accounts until you have read these Service Terms and Conditions and have acknowledged doing so by clicking the "I Accept" button at the bottom of this page.
As the user of the Service, and upon your acceptance of the Service Terms and Conditions, in order to process payments you will be required to submit your banking account or credit card account (your "Designated Account") information. You are responsible for any legal, regulatory, or banking penalties and fees that may be assessed for supplying false information to us for use with the Service.
This Service and the processing of payments from your Designated Account may be provided, operated, or serviced by our subcontractors or third party service providers, including but not limited to data hosting, data servicing, and data verification providers, e-mail vendors, technical service providers, and financial institutions ("Subcontractors"). By using this Service, you authorize us to share information with, and use the services of our Subcontractors to process your payments. Except as provided in the Service Terms & Conditions, and in our Privacy Policy and Terms of Use, your information is not shared with third parties.
The Service can only be used for payment on commercial accounts. Our obligations regarding any payments you choose to have processed through this Service are subject to the terms of any separate agreement under which such payment obligations arise. The Service Terms & Conditions shall govern only the processing of payments from your Designated Account through this Service and not the underlying payment obligations.
You must be a properly authorized signer for your Designated Account. You are responsible for your Designated Account information. We may treat any person providing your Designated Account Information as having authority to access your Zurich account and act on your behalf with respect to the use of this Service.
You must maintain a valid e-mail address where you can receive messages, validation instructions, and other notices from us and our Subcontractors to use the Service. You agree to receive electronic communications from us and our Subcontractors regarding the Service, including but not limited to communications regarding your account profile, status and usage; changes to the Service, and payments made by you through the Service.
By accepting these Terms and Conditions, you authorize Zurich American Insurance Company to initiate a debit or charge to your Designated Account according to your instructions. Each time you use the Service to pay your Zurich bill, you will be reauthorizing us to debit or charge your Designated Account.
By accepting these Terms and Conditions, you represent and warrant that:
You are 18 years old or older;
You are using your actual identity and any information you provide is accurate and complete;
You are legally authorized to make payments using your Designated Account;
You have read and agreed to our Service Terms & Conditions, Privacy Policy, and of Use; and
Your use of the Service will not violate any local, state, national or international laws or regulations.
